Terms and Conditions of Sale

2. Scope
These Terms and Conditions of Sale apply to all sales of products concluded on the Site, whatever the geographical area of the Customer, within the limits of the countries served by the Site. Pure Padel Store reserves the right to amend these Terms and Conditions of Sale at any time; the applicable terms are those in force on the date of the order.
3. Products
The products offered for sale are those appearing on the Site on the day it is consulted: padel rackets and, where applicable, padel accessories and equipment. Each product is accompanied by a description setting out its essential characteristics.
The photographs, descriptions and characteristics are provided for information purposes and have no contractual value as regards minor differences (shades of colour, changes made by the manufacturer). Offers are valid while stocks last. Pure Padel Store may not be held liable for unintentional errors or omissions.
4. Prices
Prices are stated in euros (€), all taxes included. Delivery is free of charge on all orders: no delivery costs are added at the time of payment. Pure Padel Store reserves the right to modify its prices at any time; the product is invoiced on the basis of the price in force at the time the order is validated.
5. Orders
The Customer selects the products, adds them to the basket, then validates the order after having checked its contents. Validation of the order constitutes acceptance of the displayed prices, of the product descriptions and of these Terms and Conditions of Sale.
The order is final only after confirmation of payment. A confirmation e-mail is sent to the Customer. Pure Padel Store reserves the right to cancel or refuse any order in the event of suspected fraud, a manifest pricing error, a previous payment dispute or non-payment.
6. Payment
Payment is due immediately upon placing the order. It is made online by the secure payment methods offered on the Site via Shopify (bank card, Apple Pay, PayPal, Shop Pay, subject to availability). Payment data is transmitted securely and is not stored by Pure Padel Store.
The Customer warrants that they are fully authorised to use the selected means of payment. Should payment be refused, the order is automatically cancelled.
7. Delivery
The products are delivered to the address indicated by the Customer when placing the order, within the areas served by the Site. Pure Padel Store uses third-party carriers, both in France and internationally. A tracking number is communicated to the Customer by e-mail as soon as the order is dispatched.
Delivery times are given for information purposes; they are on average 10 to 12 business days and may vary according to the country of destination, any customs checks and periods of high activity. In the event of a significant delay beyond the control of Pure Padel Store, the Customer will be informed. The transfer of risk takes place upon delivery of the product to the Customer.
8. Right of withdrawal
In accordance with articles L221-18 et suivants du Code de la consommation (French Consumer Code), the Customer has a period of 14 days from receipt of the order to exercise the right of withdrawal, without having to give any reason or pay any penalty.
9. Returns, damaged or lost products, and refunds
The terms for returns, exchanges and refunds are detailed in the Refund Policy available on the Site. Beyond the statutory 14-day right of withdrawal, Pure Padel Store accepts returns within a commercial period of 30 days from receipt, under the same conditions as to the state of the product.
In the event of a product damaged or lost during transport, the Customer must contact customer service within a reasonable time, providing the necessary evidence (photographs, order number). Pure Padel Store undertakes to propose an appropriate solution (reshipment, refund) after verification.
10. Legal warranties
Independently of any commercial warranty, Pure Padel Store remains bound by the legal warranty of conformity (articles L217-3 et suivants du Code de la consommation – French Consumer Code) and by the warranty against hidden defects (articles 1641 et suivants du Code civil – French Civil Code), allowing the Customer to choose between rescission of the sale or a reduction of the price. 11. Retention of title
The products remain the property of Pure Padel Store until full payment of the price, including costs and taxes.
12. Liability
Pure Padel Store may not be held liable for any improper or non-compliant use of the products, for normal wear and tear related to sporting practice, nor for indirect damage, financial or commercial losses. Its liability is, in any event, limited to the amount of the order concerned. These clauses may not set aside the rights the Customer derives from mandatory legal provisions, in particular as regards legal warranties.
13. Force majeure
Pure Padel Store may not be held liable for any delay or non-performance resulting from an event of force majeure within the meaning of article 1218 du Code civil – French Civil Code – (natural disaster, strike, epidemic, major logistical disruption, etc.).
14. Intellectual property
All the elements of the Site (texts, logos, trade marks, layout) are protected by intellectual property law and remain the property of KSB GROUPE (Pure Padel Store) or of its partners. Any reproduction or exploitation, in whole or in part, without prior written authorisation, is strictly prohibited.
15. Personal data
The personal data collected is processed in accordance with the Privacy Policy of the Site and with Regulation (EU) 2016/679 (GDPR) as well as with the loi Informatique et Libertés (French Data Protection Act). The Customer has a right of access, rectification, erasure, objection and portability, which may be exercised at the address contact@purepadelstore.com.
16. Applicable law and disputes
These Terms and Conditions of Sale are governed by French law. In the event of a dispute, the Customer may have recourse to conventional consumer mediation or to the European online dispute resolution platform (https://ec.europa.eu/consumers/odr). Failing an amicable resolution, the French courts shall have jurisdiction.
